General Terms and Conditions

These terms and conditions between Kubik János (H-3700 Budapest, Kazincbarcika Vájár u. 6.,
VAT-number: 68163781-1-25) (hereinafter referred to as: Operator/Lessor), provider of
BUDAPESTROLLING tour services (hereinafter referred to as: Service), and between the service
user (Participant/Lessee) form a bilateral agreement that details, for the benefit of the Operator and the Participant, instructions for using the Service, requirements for the intended usage of the devices, behavioural and traffic regulations, liability for damage claims arising from misuse and other grounds, and guidance notes for the parties on any questions that may arise in regards of the tour.

Terms of Participation
The Lessee must hold a valid personal identification document (e.g. identity card and residency
card, or passport, or driving licence) to participate in tours organized with electric vehicles
(hereinafter referred to as: Device).
The Lessor shall make a copy of this document as assurance. Before the start of the tour all Participants must sign a General Disclaimer and Waiver of Rights that excludes the liability of Kubik János entrepreneur for any damages arising from the usage of the Device (e.g. non-adherence to traffic regulations, ignoring the instructions of tour guides, injuries or damages caused to third parties).
The Device is operated solely under the responsibility of the participant!
Kubik János entrepreneur assumes no liability for any accidents or damages arising during the term of the lease. The Lessee is liable for any damages to the Device arising from ignoring the tour guide’s instructions.
Please, keep to the previously agreed schedule. The Operator shall only allow 15 minutes of delay beyond the schedule agreed upon. In case of a delay more than 15 minutes, the Lessor may unilaterally terminate the tour. In this case, the Lessee is not entitled to a refund for the previously paid sum and is not entitled to modify the date of the service or to transfer it to another person.

Grounds for exclusion from service:
- weight under 35 kg or over 120 kg- height under 120 cm- being under 10 years of age- persons between 10 and 18 years of age may only use the Device if accompanied by an adult.- pregnancy, being under the influence of alcohol/drugs/medication, improper health condition (e.g. vision impairment, dizziness, extremely high or low bloodpressure, etc.), any other handicaps arising from physical disabilities that may impede safe usage of the Device -
Terms of Booking
The Lessee may initiate booking online, via phone, or personally, by contacting a sales representative.
When booking the Participant must provide the following information:
- name
- phone number
- email address
- name of the selected tour
- exact date of the tour (year, month, day)
- exact start time of the tour (hour, minute)
- preferred language (Hungarian/English)
Additionally, the Participant must accept the General Terms and Conditions.
The Lessee will receive a confirmation message to the email address provided by the Lessee, whether they have made the reservation via email, phone, or through the website.
The message shall contain information on the finalization of the Service booked, on the terms of payment, and on the conduction of the tour and the usage of the Device.
To ensure participation in the Service, Participants of the tour must follow the instructions provided in the email. Participation in the Service is finalized by signing the General Disclaimer and Waiver of Rights and by paying for the Service. Signing the General Disclaimer and Waiver of Rights is considered contracting with the Operator.
A booking may be terminated via cancellation.
The Lessee may cancel a booking 24 hours before the tour, at the latest - if the booking is cancelled within 24 hours of the tour, we will not be able to provide a refund for any down payments.
A booking may be cancelled by calling +36-30-222-5546 or by sending an email to info@budapestrolling.hu. In case of extreme weather - if the tour is not feasible - Participants must schedule a tour at another date. If no other date for the tour proves feasible, the Lessee is refunded for any payments they have made.
Participants may not make unilateral modifications to their booking.

Terms of Payment
To finalize the order the Lessee is required to transfer 20% of the price of the Service as down payment to the bank account (12100011-17872979-00000000) of Janos Kubik (as Lessor) at Granit Bank. The message accompanying the transfer must contain the identification number of the confirmation email. The transfer must be completed at least 2 business days before the start of the tour.
Down payment may be paid in cash, at a meeting location previously agreed upon by both parties. If the down payment is paid for in cash, the full price of the Service must be paid at least 24 hours before the start of the tour. The remaining 80% of the price of the Service is paid on location, at the start of the tour.
The Operator can only guarantee completion of the Service requested by the Participant if the Participant has paid the participation fee in full.

Terms of Use
Upon the start of the Service, the Lessee receives a training involving a lesson on the use of the device. The Lessee agrees to be bound by the rules and lessons presented during the training. The training requires Participants to be minimum 35 kg and maximum 120 kg of weight and minimum 120 cm of height. Persons between 10 and 18 years of age require the participation of a parent/guardian and their written permission to use the Device. If the Participant ignored the grounds for refusal and it is discovered that they do not meet the termsof use of the Device because of their age, health condition, or physical condition, the Operator may unilaterally and on location deny usage of the Device to the Lessee who has deliberately mislead them. In this case, the Lessee is not refunded for any payments they have made. -
Binding rules
In order to participate in the Service the Participant must read and sign the General Disclaimer and Waiver of Rights (hereinafter referred to as: Disclaimer). By signing the Disclaimer, the Participant accepts to be bound by it and acknowledges that they may not ignore its provisions even under their own responsibility. Furthermore, the Participant acknowledges that the Lessor cannot be held liable for any accidents arising from the fault of the Participant and that they may not claim any damages relating to any such accidents. The Device is operated solely under the responsibility of the Participant. The Participant may only use the Device in accordance with its intended use and with the instructions provided by the Lessor and their employees. The Participant acknowledges that they are liable for any damages arising from their misuse of the Device. The Lessor assumes no liability; expressly denies liability. The Operator assumes no liability and may not be held liable for any damages to third parties or to any private- or public property or device arising from the Participants usage of the Device; the Participant has to bear the cost of any such damages.- A weight under 35 kg or over 120 kg excludes the person from using the device.- Persons under 10 years of age may not use the Device.- Persons between 10 and 18 years of age may only use the Device in the presence of an adult and with their written permission.- Only a single person may travel on a Device. Transporting other persons (especially children) is prohibited.- Flat shoes are mandatory. High heels, stiletto heels and high sole shoes constitute accident hazards and wearing them while using the device is prohibited.- Head protection and, for Participants less than 18 years of age, knee pads, elbow pads and gloves are mandatory and provided by the Operator. Upon request, the Operator shall alsoprovide this equipment to Participants over the age of 18.- Usage of the Device is prohibited for pregnant women, persons with physical disabilities, and persons under the influence of alcohol, drugs, or medication.- The Participant is solely responsible for any problems, accidents, medical issues, or events requiring action by medical or emergency service providers resulting from any diseases notrevealed to the Lessee.- Handover of the Device to another person is not permitted.- Traffic regulations (rule of the road) and safety regulations must be observed in full while using the Device.- While driving the Device only roads reserved for pedestrian and bicycle traffic may be used.- Devices must only be operated within eyesight of the employees of the Operator. Personnel exchanges for the Device during the tour are not feasible.- Photographing and using the phone while driving is strictly prohibited.- The Device must be used in accordance with the instructions provided during the training; deviation from the instructions is prohibited.- Exiting the vehicle while in use is prohibited. Both feet must be kept on the standing area at all times, because the pressure sensors in these areas need to be loaded for the Device to operate.- Both hands must be kept on the handles of the Device at all times while driving. Hands-free and one handed driving is expressly forbidden.- Driving speed while using the Device must be determined in accordance with traffic and driving conditions. The Participant must pay attention to and avoid potholes, puddles, rough terrain and road damage. Driving over curbs and other obstacles is hazardous and prohibited. The Device must be pushed, pulled, or lifted over any such obstacles.- The Participant, bearing full liability for any damages, may be excluded if they leave the area designated for the use of the Device (e.g. designated tour route, practice area), or endanger their own physical well-being or the physical well-being of others (e.g. crashing). The Lessee may be excluded if they fail to follow the instructions provided by the Operator or their employees. In the event of exclusion paid participation fees are non-refundable.- Any damages to the Device must be immediately reported to the Lessor. If the Participant fails to report such damages, the Operator, assuming wilful damage, may take legal action forcompensation.
